Help, license checks and lost policies in Florida

The Florida Department of Financial Services (DFS) Division of Consumer Services helps with life insurance questions and complaints. The Insurance Consumer Helpline is 1-877-693-5236, or (850) 413-3089 from out of state.

DFS advises checking the agent and the company before you sign an application. Its free Licensee Search tool lets you look up an agent by name. Availability of any product depends on your state and the carrier.

DFS points families to the free NAIC Life Insurance Policy Locator. Insurers search their records and contact you if you are the beneficiary. DFS notes that MIB also offers a locator, for a fee.

For veterans' life insurance, DFS says you can check with the VA at 1-800-669-8477. Florida's unclaimed property search is at claimyourcashfl.gov.

Free look: at least 14 days

Florida gives you at least 14 days after delivery to review a life policy. If you return it in that time, you get a full premium refund with no surrender charges.

DFS suggests asking the agent to sign and date the policy when it is delivered. If it comes by mail, note the date on the envelope. That date starts your 14 days.

Grace period and the secondary addressee rule

Florida law requires a grace period of at least 30 days for premiums after the first. The policy stays in force during that time, and an unpaid premium can be deducted from a claim.

If the insured is 64 or older and the policy has been in force at least one year, there is an extra safeguard. The insurer must mail a lapse notice to the owner and to a secondary addressee at least three weeks before the policy lapses.

You name the secondary addressee in writing, at application or later. Many Florida retirees pick an adult child. Some policies are excluded, such as those with monthly premiums collected by an agent or paid automatically by card or bank draft.

Guaranty association protection

The Florida Life and Health Insurance Guaranty Association (FLAHIGA) protects residents if a member insurer fails. It covers up to $300,000 in death benefits and $100,000 in net cash surrender value per insured life.

That is plenty for most final expense policies. For larger term or whole life coverage, you can split coverage between carriers to stay under the limit. See our carrier reviews for ratings.

Final expense for Florida retirees

Many Florida buyers are retirees who want a small policy to pay for a funeral and final bills. Final expense insurance is whole life with a smaller face amount, and it does not expire. See the typical estimates above by age.

The NFDA put the national median funeral with viewing and burial at $8,300 in 2023, and $6,280 with cremation. Those figures exclude cemetery costs. We did not find a Florida-specific figure from a state source.

If you have serious health issues, guaranteed issue policies accept everyone but usually pay only premiums plus interest for the first two to three years. Our guide to waiting periods explains the trade-off. Compare coverage over 70 if that is your age range.

When term life fits better

Floridians still paying a mortgage or supporting family usually need term life instead. A 20-year term costs far less per dollar of coverage than permanent insurance.

Florida is not a community property state, per IRS Publication 555. That makes beneficiary choice simpler than in Texas or California, but update it after any marriage or divorce.

Buying a policy in Florida, step by step

Decide first whether you need a funeral fund or income protection. That choice points you to final expense or to term life.

Compare offers from several carriers. Final expense prices depend on age, health answers and tobacco use, and some carriers accept conditions that others decline.

On the application, name a secondary addressee if you are 64 or older, or will be soon. It costs nothing and can save a policy after a missed payment.

When the policy arrives, write down the delivery date. You have at least 14 days to read it and return it for a full refund.
