Life Insurance in California: Rates, Rules and Consumer Protections

California gives life insurance buyers some of the strongest protections in the country. Every policy must have a 60-day grace period, and buyers aged 60 or older get at least 30 days to return a new policy for a refund. Rates are set by each carrier, so the tables below are typical estimates, not California-only prices.

Help, license checks and lost policies in California

The California Department of Insurance (CDI) licenses agents and insurers and handles complaints. Its consumer hotline is 1-800-927-4357, and you can file a life insurance complaint online through the CDI website.

Before you buy, check the agent on the CDI "Check License Status" page. You can search by name or license number, and it takes a minute. Availability of any product depends on your state and the carrier.

If a parent died and you think there was a policy, start with the free NAIC Life Insurance Policy Locator. Participating insurers search their records and contact you directly if you are the beneficiary.

You can also search the State Controller's ClaimIt unclaimed property site at claimit.ca.gov, where unpaid funds may end up.

Free look: 30 days if you are 60 or older

If you are 60 or older on the day you buy, California requires at least a 30-day window to return an individual life policy. The notice must appear on the policy, and the period runs from delivery.

If you return it in time, the policy is treated as never issued. The insurer must refund premiums and any policy fee within 30 days of your cancellation notice. Variable policies follow a slightly different refund rule tied to account value.

For buyers under 60, the return window is printed on the first page of the policy. Read it the day the policy arrives.

Grace period and lapse notices

California requires a grace period of at least 60 days, which is double what many states require. Your coverage stays in force during that time.

A policy cannot lapse for nonpayment unless the insurer mails a notice at least 30 days before termination. That notice goes to you, to any person you designated, and to any known assignee.

When you apply, the insurer must let you name at least one extra person to receive lapse notices. This is useful for parents buying final expense coverage, since an adult child can catch a missed payment. The insurer must remind you each year that you can change the designee.

Guaranty association protection

If a life insurer fails, the California Life and Health Insurance Guarantee Association steps in. It covers 80% of a death benefit up to $300,000, and 80% of cash surrender value up to $100,000.

The total for life and annuity benefits on one person is $300,000, no matter how many policies you hold with that insurer. If you need more coverage than that, spreading it across two carriers can keep each policy under the cap. Check carrier financial strength too; our carrier reviews list AM Best ratings.

Community property and your beneficiary

California is a community property state. Property acquired during marriage is generally owned by both spouses, according to IRS Publication 555.

Premiums paid from wages earned during marriage can give your spouse an interest in the policy. If you plan to name someone other than your spouse, speak with a California estate attorney before you sign.

Choosing term or final expense in California

Working-age families usually start with term life, sized to the mortgage and years of income. A 20-year term is the most common choice; see the table above for typical estimates by age.

Retirees often want a small permanent policy for funeral costs instead. Nationally, the NFDA put the median funeral with viewing and burial at $8,300 in 2023, and $6,280 with cremation. Those figures exclude cemetery costs and can run higher in expensive California metros. Compare options at final expense over 65 or use the life insurance calculator.

Buying a policy in California, step by step

Start by deciding what the money must do. Income replacement and a mortgage point to term life; a funeral and final bills point to a small permanent policy.

Next, compare quotes from several carriers, because each one files its own rates. Two people the same age can get very different offers based on health, height and weight, and tobacco use.

When you apply, name your lapse notice designee on the form. When the policy arrives, note the delivery date. If you are 60 or older, you then have at least 30 days to read it and change your mind.

If you are replacing an older policy, keep the old one until the new one is approved and in force. A new policy usually restarts the contestable period.
