Help, license checks and lost policies in Texas

The Texas Department of Insurance (TDI) licenses agents and insurers and takes consumer complaints. Its help line is 800-252-3439.

TDI's website has a "Look up a company or agent" tool. Use it to confirm an agent is licensed before you sign anything. Availability of any product depends on your state and the carrier.

Start with the free NAIC Life Insurance Policy Locator. If an insurer finds a policy and you are the beneficiary, the insurer contacts you.

Unpaid benefits may also be turned over to the state. Search the Texas Comptroller's ClaimItTexas site for the deceased person's name.

Free look and grace period in Texas

TDI says Texas policies have a free-look period of at least 10 to 20 days. During that time you can cancel for any reason and get a full refund. Your exact window is printed on the policy.

Most Texas policies have a 31-day grace period after the premium due date. You can pay during that time with no interest, and coverage stays in force. If a premium is still unpaid after that, the policy can end.

Set up automatic payments if you can. A missed draft is the most common way people lose coverage they meant to keep.

Replacing a policy in Texas

TDI warns that it is illegal for an agent to replace your policy just to earn a new commission. If you think that happened, you can file a complaint with TDI.

Replacing also has real costs. A new policy restarts the two-year contestable period and may need new health questions or an exam. It may also take longer to build cash value. Keep the old policy until the new one is approved and in force.

Guaranty association protection

The Texas Life and Health Insurance Guaranty Association protects residents if a member insurer fails. It covers up to $300,000 in death benefits and $100,000 in cash surrender value per life.

The overall limit for one life is generally $300,000. Benefits under several policies on the same person are added together before the limit applies. If you need more coverage, consider splitting it between two carriers. See our carrier reviews for financial strength ratings.

Community property and beneficiaries in Texas

Texas is a community property state, so property acquired during marriage is generally owned by both spouses, per IRS Publication 555. A policy paid with marital income can be part of that.

TDI notes you can name more than one beneficiary. If you name none, or your beneficiary has died, the benefit goes to your estate. If you want to name someone other than your spouse, talk to a Texas estate attorney first.

Term or final expense: what Texans usually buy

Families with a mortgage or young kids usually need term life first. A 20-year term covers the years when income matters most; see the typical estimates above and our rates at age 30.

Older Texans often add a small final expense policy for burial costs. The NFDA put the national median funeral with viewing and burial at $8,300 in 2023, and $6,280 with cremation. Those medians exclude cemetery charges, and we did not find a Texas-specific figure from a state source.

Buying a policy in Texas, step by step

First, size the coverage. A common starting point is enough to pay off debts and replace several years of income; the life insurance calculator walks through it.

Second, compare quotes from more than one carrier. Prices vary by carrier, health class and tobacco use, not by a Texas price list.

Third, answer the application honestly. TDI reminds buyers that during the two-year contestable period, an insurer can deny a claim over wrong or missing information.

Finally, note the delivery date and read the policy during the free-look window. Confirm the beneficiary names and the premium schedule before that window closes.

Many Texas households use both products. A common setup is a 20-year term policy for the working years and a small final expense policy for each parent.
